DATA SECURITY & STORAGE POLICY

1. INTRODUCTION

This policy is the regulation of OPEN HEALTHCARE VIETNAM JOINT STOCK COMPANY (OHVN) on user rights and data access policy. OHVN is committed to protecting customer privacy and complying with Vietnamese law on personal data.

By clicking on the “Agree” option when accessing, installing the application or using our services, you (“User”) commit to having read and understood the entire content, agreeing to comply with all the terms in our Policy below:

2. USER RIGHTS

During the process of OHVN managing and processing data, Users have the following rights:

  • 2.1. Right to data access: Users may request OHVN to provide information on the types of personal data collected, the purposes for which it was used, and the third parties with whom the data has been shared (if any). OHVN will provide a copy of the personal data if the user has a valid request.
  • 2.2. Right to data correction: Users have the right to request correction or update of personal data if the data is inaccurate or incomplete.
  • 2.3. Right to data deletion: Users may request OHVN to delete personal data in the following cases:
    • Data is no longer needed for the original purpose for which it was collected.
    • The user withdraws consent that previously allowed data processing.
    • Data processed illegally.
    OHVN will delete data within 72 business hours, unless there is a legal requirement to retain it.
  • 2.4. Right to object to data processing: Users have the right to object to OHVN's processing of personal data in certain circumstances, in particular for automated marketing or analysis purposes.
  • 2.5. Right to withdraw consent: Users can withdraw their consent to the processing of personal data at any time, however this may affect the services provided by OHVN.
  • 2.6. Right to data portability: Users may request OHVN to provide their personal data in a portable format for use with other services (if available).
  • 2.7. Other rights: as prescribed by law.

3. METHODS OF EXERCISING RIGHTS

  • 3.1. Data on website/application: Users directly log in to OHVN's website/application to edit, add or delete information on the account interface. OHVN will process the request within 72 hours of receipt.
  • 3.2. Cookies on the website: Users can refuse to store cookies in the Browser Settings section, select “Block all cookies”. OHVN cookies will stop collecting information immediately.
  • 3.3. Other data: Send request via email to info@ohvn.vn . OHVN will process and respond within 72 working hours.

4. DISCLAIMER

OHVN is committed to protecting personal data but is not responsible in the following cases:

  • User is unauthorized access due to exposed login information.
  • Security incidents due to cyber attacks, system errors, malware.
  • Third party issues (such as hosting, payment, operating system providers).
  • Changes in legal policies affecting data security.
  • Users modify, delete, or misuse data themselves.
  • OHVN system maintenance causing service interruption.

It is the user's responsibility to protect their personal account and not share information with unauthorized parties.

5. PROVISIONS ON POLICY CHANGES

OHVN reserves the right to adjust policies to comply with the law or improve services. Important changes will be announced at least 07 days in advance via the website or platform.

If you do not agree with the changes, you have the right to stop using the service. Continued use is considered acceptance of the new terms.

6. GOVERNING LAW, RESOLUTION OF COMPLAINTS AND DISPUTES

Policy complies with Vietnamese law.

Complaints will be handled within 30 working days. Disputes will be resolved through negotiation; if not, the court at the place where OHVN is headquartered will handle. Dispute costs will be borne by the losing party.

4. DISCLAIMER

OHVN is committed to protecting personal data but disclaims responsibility in cases such as:

  • Unauthorized access caused by the user disclosing login credentials.
  • Security incidents due to hacking, malware, or system failures.
  • Issues caused by third-party services (eg, hosting, payment gateways).
  • Legal changes affecting data protection policies.
  • User-modified or misused data.
  • System maintenance that interrupts services.

Users are responsible for protecting their accounts and following OHVN's security guidance.

5. POLICY CHANGES

OHVN may adjust the policy to comply with laws or improve services. Significant changes will be announced at least 7 days in advance on our website or platform.
