USER RIGHTS DATA ACCESS POLICY

1. INTRODUCTION

This policy is the regulation of OPEN HEALTHCARE VIETNAM JOINT STOCK COMPANY (OHVN) on user rights and data access policy. OHVN is committed to protecting customer privacy and complying with Vietnamese law on personal data.

By clicking on the "Agree" option when accessing, installing the application or using our services, you ("User") commit to having read and understood the entire content, agreeing to comply with all the terms in our Policy below:

2. USER RIGHTS

During the process of OHVN managing and processing data, Users have the following rights :

2.1. Data access rights

Users may request OHVN to provide information about the types of personal data collected, the purposes for which it was used, and the third parties with whom the data has been shared (if any).

OHVN will provide a copy of personal data upon valid request from the user.

2.2. Right to data correction

Users have the right to request correction or updating of personal data if the data is inaccurate or incomplete.

2.3. Right to data erasure

Users may request OHVN to delete personal data in the following cases:

  • Data is no longer needed for the original purpose for which it was collected.
  • The user withdraws consent that previously allowed data processing.
  • Data processed illegally.

OHVN will delete data within 72 business hours, unless there is a legal requirement to retain it.

2.4. Right to object to data processing

Users have the right to object to OHVN processing of personal data in certain circumstances, in particular for automated marketing or analytical purposes.

2.5. Right to withdraw consent

Users can withdraw their consent to the processing of personal data at any time, however this may affect the services OHVN provides.

2.6. Right to data portability

Users may request OHVN to provide their personal data in a portable format for use with other services (if applicable).

2.7. Other rights as prescribed by law.
3. METHODS OF EXERCISING RIGHTS
3.1. For data that can be modified, added, replaced, or deleted directly on the website/application

Users directly log in to OHVN's website/application, at the account information interface, Users proceed to modify, supplement, replace, delete user data for information that has been or has not been provided.

OHVN will execute the User's request automatically or as soon as possible within the next 72 hours from the User's request.

3.2 For cookies that track website activity

Users can optionally accept or not accept cookie storage in the browser they use.

In case the User refuses Cookie tracking, the User operates in the Settings section of the browser, searches for "Cookies" and selects the option "Block all cookies". OHVN's Cookies will immediately stop collecting the User's information.

3.3. For other data

Users can exercise their rights by sending an email with a specific request to the address: info@ohvn.vn.

Within 72 working hours of receiving the request, OHVN will process the request and notify the User of the processing result.

4. DISCLAIMER

OHVN is committed to implementing the highest standards of personal data protection. However, in all cases, OHVN disclaims all legal liability related to users' personal data, including but not limited to:

  • Unauthorized access & security breach from users: OHVN is not responsible for any loss caused by users disclosing login information or failing to take necessary security measures.
  • Cyber ​​attacks, system failures, or security incidents beyond our control: OHVN is not responsible for incidents related to hackers, malware, or technology infrastructure failures.
  • Third Party Incidents: OHVN is not responsible for any loss caused by third party services (such as hosting providers, payment gateways, independent operating systems).
  • Changes in legal policy: OHVN is not responsible for any changes in Vietnamese or international law that affect the data privacy policy.
  • Data edited, deleted or misused by users: Users are fully responsible for the processing of their personal data.
  • System Maintenance and Service Interruptions: OHVN reserves the right to maintain, upgrade or suspend the system for technical reasons without being responsible for any service interruptions.

It is the responsibility of the user to protect his/her personal account, comply with OHVN's security guidelines and not share personal information with any unauthorized parties.

5. PROVISIONS ON POLICY CHANGES

OHVN reserves the right to change, update or adjust the privacy policy, terms of use and related regulations to meet legal requirements, adjust to operational practices or improve service quality. Any significant changes will be announced at least 07 days in advance via OHVN's website or service platform.

In the event of any amendment to the Policy, the user has the right to refuse to continue using the service if he/she does not agree with the changes. Continued use is understood as the user's agreement to the new terms.

6. GOVERNING LAW, RESOLUTION OF COMPLAINTS AND DISPUTES

All terms and policies of OHVN are governed by and comply with the current laws of the Socialist Republic of Vietnam.

In case of any complaint related to OHVN's data policy, customers please contact OHVN for resolution within a maximum period of no more than 30 working days from the date OHVN receives the complaint; except in cases where the complaint is complicated.

Any dispute or complaint arising from or related to OHVN's policy shall be resolved by the parties through negotiation and conciliation in good faith. If no agreement is reached, the dispute shall be resolved by the competent court where OPHC is headquartered, unless otherwise agreed upon by the parties or required by law. The final decision of the court shall be binding and the parties shall comply. All costs related to dispute resolution, including but not limited to legal costs (including reasonable attorneys' fees), court and other fees, shall be borne by the losing party.

By selecting the "Agree" option when accessing, installing the application, or using our services, you ("User") confirm that you have read, understood, and fully agreed to comply with the terms of our policy below:

During OHVN's management and processing of data, Users have the following rights:

2.1. Right to Access Data

Users may request OHVN to provide information regarding the type of personal data collected, its purpose of use, and any third parties with whom the data has been shared (if applicable).

OHVN will provide a copy of the personal data if the user submits a valid request.

2.2. Right to Rectify Data

Users have the right to request corrections or updates to their personal data if the information is inaccurate or incomplete.

2.3. Right to Erase Data

Users may request OHVN to delete their personal data in the following cases:

  • The data is no longer necessary for the original purpose of collection.
  • The user withdraws consent previously given for data processing.
  • The data has been processed unlawfully.

OHVN will delete the data within 72 working hours, except in cases where legal regulations require retention.

2.4. Right to Object to Data Processing

Users have the right to object to OHVN processing their personal data in certain circumstances, particularly for marketing or automated analysis purposes.

2.5. Right to Withdraw Consent

Users may withdraw their consent for personal data processing at any time; however, this may affect the services provided by OHVN.

2.6. Right to Data Portability

Users may request OHVN to provide their personal data in a portable format for use with another service (if any).

3.2. For cookies tracking activity on the website

Users may choose to accept or decline the storage of cookies in the browser they are using.

If users choose to reject tracking via cookies, they can access their browser settings, search for the "Cookies" section, and select the "Block all cookies" option. OHVN cookies will immediately stop collecting the user's information.

3.3. For other types of data

Users may exercise their rights by sending an email with specific requests to: info@ohvn.vn.

Within 72 working hours from receiving the request, OHVN will process the request and notify the User of the outcome.

4. DISCLAIMER

OHVN is committed to implementing the highest standards of personal data protection. However, in all cases, OHVN disclaims any legal liability related to users' personal data, including but not limited to:

  • Unauthorized access & security highlighted from the User: OHVN is not responsible for any loss due to the user disclosing login information or failing to take necessary security measures;
  • Cyber ​​attacks, system errors, or security incidents beyond control: OHVN is not responsible for incidents related to hackers, malware, or technology infrastructure failures.
  • Incidents caused by third-party services (such as hosting providers, payment gateways, independent operating systems);
  • Changes in legal policies: OHVN is not responsible for any changes in Vietnamese or international laws affecting data security policies;
  • Data modified, deleted, or misused by the user: Users are entirely responsible for their personal data processing behavior;
  • System maintenance and service interruptions: OHVN has the right to maintain, upgrade, or temporarily suspend the system for technical reasons without being charged for any service interruptions.

Users are responsible for protecting their personal accounts, following OHVN's security instructions, and not sharing personal information with any unauthorized parties.

5. POLICY CHANGES

OHVN reserves the right to change, update, or adjust the privacy policy, terms of use, and related regulations to meet legal requirements, adapt to operational practices, or improve service quality. Any significant changes will be notified at least seven (07) days in advance via OHVN's website or service platform.

In the event of any amendments to the Policy, users have the right to refuse continued use of the service if they do not agree with the changes. Continued use of the service shall be considered as the user's acceptance of the revised terms.

6. GOVERNING LAW, COMPLAINT AND DISPUTE RESOLUTION

All OHVN terms and policies are governed and compiled with under the laws of the Socialist Republic of Vietnam.

In case of any complaints related to OHVN's data policy, customers are requested to contact OHVN for resolution within a maximum period of thirty (30) working days from the date OHVN receives the complaint, except in cases of complex complaints.

Any disputes or claims arising from or related to OHVN's policy will be prioritized for resolution through negotiation and amicable settlement in good faith. If no agreement is reached, the dispute will be resolved at the competent court where OHVN's head office is located unless otherwise agreed by the parties or required by law. The court's final decision will be binding, and the parties must comply. All related to dispute resolution, including but not limited to legal fees (including reasonable costs attorney fees), court fees, and other expenses, will be borne by the losing party.
